When someone loses the ability to manage their own affairs and needs someone to effectively take over that role, there are essentially two routes available to the person looking to help. These are Lasting Powers of Attorney or a Deputyship Order through the Court of Protection.
If the person who has lost capacity has drafted a Lasting Power of Attorney, that has been signed and witnessed correctly and been registered with the Office of The Public Guardian, this would allow their chosen attorney to step in and act. We are specialists in preparing Lasting Powers of Attorney, and having them officially registered with the Office of The Public Guardian.
Where a Lasting Power of Attorney doesn’t exist, the person looking to help, usually a spouse, partner or other loved one, must apply to the Court of Protection for a Deputyship order. The Court of Protection is a specialist Court that deals with decision making on behalf of people who do not have the capacity to make decisions for themselves. ​There are many types of application that can be made, all with their own Court of Protection forms and required documents.
